This is a petition for grant of anticipatory bail for offence under Sections 498A, 323 and 420 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act. The petitioners are relations of the husband. Allegation is of demand of dowry and torture for the
Patna High Court Cr.Misc. No.15434 of 2017 (2) dt.20-04-2017 same.
Submission of the petitioners is that husband is not an accused in this case and due to some dispute of compatibility between the two spouses, the family members are being harassed by filing false case. The learned counsel for the informant opposed the prayer on the ground that the marriage was a love marriage and after marriage the petitioners are demanding dowry and torturing for the same.
Considering the general and omni bus allegation, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Khagaria (Chitargupta Nagar) P.S. Case No. 679 of 2016 to the satisfaction of the Chief Judicial Magistrate, Khagaria, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
