JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-03-2017 The petitioner is apprehending his arrest in connection with Pranpur P.S. Case No. 84 of 2016, registered for offences punishable under Sections 323, 324, 456, 354(B),506/34, 376/511 Indian Penal Code.
It has been submitted on behalf of the petitioner that he has been falsely implicated in the present case due to land dispute, which clearly appears from perusal of materials collected during the course of investigation.
Learned counsel for the State opposed the prayer for bail and submitted that witnesses and the father of the informant has also supported the case of prosecution in para 8 and 9 of the case diary. However learned counsel for the State has conceded the fact that there is land dispute between the parties and some of the
Patna High Court Cr.Misc. No.3029 of 2017 (4) dt.16-03-2017 2/2 witnesses during investigation, had stated that the petitioner has falsely been implicated in this case in para 10 and 13 of the case diary.
Having heard both sides, considering the facts and circumstances of the case and the statement of independent witnesses in this case and also that the petitioner has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM- I, Katihar in connection with Pranpur P.S. Case No. 84 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Vinod Kumar Sinha, J) sunil/- U T
