Petitioner happens to be husband of the deceased and not only in the first information report but in the statement of brothers of deceased also, it has come that at the time of alleged occurrence, the petitioner was not at his house rather he was at Kathmandu. Furthermore, it has come in course of investigation that when deceased went to her parental home, it was the petitioner, who went there and took her back which is evident from perusal of paragraph-35 of the case diary. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named
Patna High Court Cr.Misc. No.31620 of 2015 (6) dt.03-11-2015 above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jogapatti P.S. Case No. 295 of 2013 to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah.
