08-12-2015 Heard Sri Ranjeet Kumar Singh, learned counsel for the petitioner and Sri Anuj Kumar Srivastava, learned Addl. Public Prosecutor.

The petitioner is in custody since 27-09-2015 due to misuse of privilege of bail. The petitioner was earlier granted bail in Kursela P.S. Case no. 34 of 1997, G.R. Case no. 975 of 1997 (SOS) for offence under Sections 144, 447, 504 of the Indian Penal Code. The petitioner's bail-bond was cancelled on 24-09-2010 and thereafter, he was arrested and since 27-09-2015, he is in custody.

In view of facts and circumstances, let the petitioner namely Nokhelal Choudhary be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the

Patna High Court Cr.Misc. No.52571 of 2015 (2) dt.08-12-2015 2/2 like amount each to the satisfaction of learned ACJM IIIrd, Katihar/concerned court in connection with Kursela P.S.
