JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 448, 307, 354, 379 and 34 of the Indian Penal Code. The prosecution case is that on 06.11.2015 at 9 'o' clock the FIR named accused assaulted the husband of the informant and her son. When the informant made protest the petitioner no. 1 Mithilesh Singh pulled her Sari by catching hold her hair and assaulted on her head with rod. Other accused persons assaulted the informant and petitioner no. 4 Vikki Singh @ Suraj Kumar Singh @ Suraj Singh tried to outrage her modesty and snatched

Patna High Court Cr.Misc. No.4318 of 2016 (2) dt.01-02-2016 2/2 away golden chain of the informant.

It is submitted by the learned counsel for the petitioners that the accusation has been levelled against the petitioners due to land dispute. There is a counter version of the occurrence. The informant has received one grievous injury but the petitioners' side has also received injuries. Statement has been made in paragraph-3 of the petition that the petitioners have got no criminal antecedent.

Considering the facts aforesaid, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 246 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Dinesh Kumar Singh, J.) Vinita/- U T
