JUSTICE BIRENDRA KUMAR ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 409, 420, 467, 468, 471 and 120B of the Indian Penal Code. The petitioner was, allegedly, appointed as a teacher on the basis of forged certificate of qualification. Submission of the petitioner is that the petitioner has already been terminated from service and is ready to refund emoluments received during tenure as teacher in twelve monthly installments.

Considering the aforesaid facts and that the petitioner is a female and mother of small children, let the petitioner, above

Patna High Court Cr.Misc. No.12857 of 2017 (2) dt.17-03-2017 2/2 named, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur/Successor Court in connection with Kotwali (Adampur) Police Station Case No. 697 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case failing which the court below shall be at liberty to cancel the bail bond of the petitioner as also with condition that the petitioner shall refund the amount in twelve monthly installments, receipt of first refund shall be deposited at the time of furnishing bail bond.
