Petitioner, already in custody, seeks bail in connection with Barahiya P.S. Case No.30 of 2017, registered under Sections 364/34 of the Indian Penal Code and subsequently Sections 302 and 201 of the Indian Penal Code were added.
Allegation in brief is that the petitioner called the informant's husband and went along with him to bring his daughter from her maternal grand father's home but the husband of the informant did not return back and suspicion is raised that the petitioner along with his daughter and wife have killed her husband.
Learned counsel for the petitioner submits that one Rajendra Singh made confessional statement that this petitioner

No.8877 of 2018(2) dt.15-02-2018 2/2 had killed the deceased and except that there is no other material, there is no motive also for killing the deceased and two other co-accused Rajendra Singh, who has made confessional statement, and the wife of the petitioner have been admitted to bail by coordinate Benches of this Court by orders dated 12.01.2018 and 28.08.2017, passed in Cr. Misc. No.62609 of 2017 and Cr. Misc. No.39629 of 2017 respectively and chargesheet has been submitted in this case. Having considered the said facts and circumstances, petitioner Niwas Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Barahiya P.S. Case No.30 of 2017 (G.R. No.220 of 2017).
