JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bochaha P.S. Case No. 145 of 2017 registered for the offences punishable under Sections 302, 307 and 120B of the Indian Penal Code.

Allegation as per FIR is of firing against accused persons, due to which brother of informant has died. Petitioner is not named in the FIR.

Submission of learned counsel for the petitioner is that two other accused persons have been granted anticipatory/regular bail by this Court and co-ordinate Bench of this Court.

Heard learned APP, who has pointed out that in this case proclamation has already been made against the petitioner. In view of above facts and circumstances, this

No.49130 of 2019(3) dt.22-10-2019 2/2 application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on the basis of materials available on the record and also considering the fact that other co-accused have been granted anticipatory/regular bail by this Court and, if possible, to be disposed of on the same day.
