JUSTICE ARUN KUMAR ORAL ORDER 14-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Pakri Barawan PS Case No. 83 of 2017 (Sessions Trial No. 674 of 2017) registered under Sections 302 and 201/34 of the IPC.
The allegation in brief is that there was strained relationship between the wife and the husband, suspicion is raised that after killing the informant's grand-daughter, who happens to be wife of the petitioner, her dead body was disposed of, the dead body of the petitioner's wife was recovered thrown in a field in a decomposed state.
Learned Counsel for the petitioner submits that his wife had disappeared and in this regard he had lodged a complaint after lodging of the FIR of the present case on 26.5.2017. However learned Counsel for the State submits that the petitioner is husband of the deceased, the dead body was found in a decomposed state in the field and cause of death is asphyxia (strangulation) and no earlier information regarding her missing was given by the husband.
Having considered the said facts and circumstances, the prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of two years. Snkumar/- (Arun Kumar, J.) U T
