JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-07-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Bodh Gaya (Cherki) P.S. Case No. 228 of 2021 registered for offence punishable under section 420/34 of the Indian Penal Code and section 63 of the Copyright Act, 1957.

As per allegation, the petitioners were selling some fake products of Hindustan Unilever and Lakme company.

No.59696 of 2021(2) dt.12-07-2022 2/2 The learned counsel for the petitioners has submitted that the petitioners are innocent, they have falsely been implicated in this case and they have no criminal antecedents. He has submitted further that the investigation is still continuing and it has not been ascertained till date that the products were fake. Considering the above-mentioned facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, be released on bail, till submission of the police report under section 173 of the Code of Criminal Procedure, on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya (Cherki) P.S.

Case No. 228 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
