The petitioner apprehends his arrest in connection with Nawada Town P.S.Case No.786 of 2015 registered under Sections 409, 420, 467, 468 and 471 of Indian Penal Code. The accusation is that under the scheme of Post Matric Scholarship for Scheduled Castes and Scheduled Tribes students the amount of post Matric scholarship were transferred by the Welfare Department, Nawada, to the five institutions which were found fake institutions amount of Rs.30/- was transferred in the account of petitioner by three institutions.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is supplier of laboratory instruments of

Patna High Court Cr.Misc. No.16834 of 2017 (4) dt.11-10-2017 2/2 the Science Department and due to that Rs.30/- lacs was transferred in the A/c of the petitioner by three institutions. Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
