The petitioners apprehend their arrest in Kotwali P.S. Case No. 436 of 2014 registered under Sections 323, 376/34 of the Indian Penal Code.
The informant alleged that she was working as a maidservant in the house of the petitioners. While she was brooming a room, at first, the petitioner no. 1 committed rape with her and, after some time, the petitioner no. 2 also committed rape with her.
Learned counsel for the petitioners submits that the narration of the story appears to be quite improbable. There is no medical report.
Patna High Court Cr.Misc. No.32914 of 2014 (2) dt.06-02-2015 2/2 It appears that there is a very specific allegation against the petitioners that they committed rape with the victim one by one.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail in Kotwali P.S. Case No. 436 of 2014. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Dilip/- U T
