Ms. Pushpa Sinha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2022 Heard learned counsel for the petitioners and Ms. Pushpa Sinha, learned A.P.P. for the State through virtual court proceedings.

The petitioners seek bail in connection with Ganga Bridge P.S. Case No. 114 of 2021 instituted for the offences under Sections 30(a), 32(2), 38(1) and 41(1) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 26.05.2021, are persons with clean antecedent and charge-sheet has been submitted in the case.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.61191 of 2021(3) dt.04-02-2022 2/2 allegation is of recovery of 3600 litres of liquor from a truck as detailed in the F.I.R.

Learned counsel for the petitioners submits that the petitioner no. 1 is the driver and the petitioner no.2 is the cleaner of the truck as such they were not aware what was loaded in the truck by the owner.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 26.05.2021, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 114 of 2021.
