1. Heard learned counsel for the petitioner as well as learned APP for the State.
2. The petitioner apprehends his/her arrest in connection with Beldaur P.S. Case No. 50 of 2022, registered for the offences punishable under Sections 379/411 of the Indian Penal Code and 21 MMDR Act, Rule 56(i)(ii) B.M. (C.P of IM) T & 34 Rule 2021 and under section 15 E.P. Act 1986.
3. As per allegation, on 27.02.2022 at about 6:15 pm a raid was conducted by the police personnel and three tractors were found illegally mining white sand to sell. On demand, no valid e-challan was produced by the drivers.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.50400 of 2023(2) dt.16-08-2023 2/2 this case and he is a person of clean antecedent and on similar footing co-accused Mina Devi has been granted bail by the learned court below.
5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Khagaria in connection with Beldaur P.S. Case No. 50 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
