JUSTICE RAKESH KUMAR ORAL ORDER 30-11-2015 Heard Sri Shambhu Nath Jha, learned counsel for the petitioner and Sri Umesha Nand Pandit, learned A.P.P. The petitioner, who is in custody since 23.8.2015 in connection with Baheri P.S. Case No. 131 of 2015, registered for the offence punishable under Section 307 and other allied Sections of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that there is general and omnibus allegation against the petitioner. He further submits that main allegation was made against one Dinesh Mandal that he gave khanti blow on the injured and thereafter other accused persons also assaulted the informant. Patna High Court Cr.Misc. No.52045 of 2015 (2) dt.30-11-2015 2/2 serious accusation has been granted anticipatory bail by this court on 2.11.2015 vide Cr. Misc. No. 44909 of 2015. Along with Dinesh Mandal one another accused namely, Jaduni Mandal was also granted anticipatory bail by the same order. Keeping in view the fact that main accused, against whom there was serious charge than the petitioner, has been granted anticipatory bail, there is no reason to detain the petitioner even for further one day. Accordingly, let the petitioner namely, Binesh Mandal @ Lattu be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Baheri P.S.
