2. The petitioner has prayed for bail in connection with Sakra P.S. Case No. 627 of 2024 registered for the offence punishable under Section 80 of B.N.S..
3. The case of the prosecution, in short, is that Nikita Kumari, the deceased was married with the petitioner on 03.12.2023. It is further alleged that the deceased was subjected to cruelty on account of non-fulfillment of dowry demand of bullet. It is further alleged that on 08.11.2024, the informant reached the matrimonial house of the deceased with prashad where she disclosed that she may be killed due to nonfulfillment of the demand of bullet. Patna High Court CR. MISC. No.48374 of 2025(4) dt.04-12-2025 2/3 admitted in Muzaffapur Hospital. The information was given by the petitioner and after some time, he received the information given by the petitioner that the deceased has died.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The occurrence is of 17.11.2024 whereas the F.I.R. has been lodged on 14.12.2024. There is considerable delay in filing of the F.I.R. From perusal of the postmortem report, it is clear that doctor has found only ligature mark of size 6"x1" on left side of neck. No other antemortem injury was found and the doctor has opined that the cause of death is Asphyxia due to hanging. It has also been submitted that the deceased was short tempered and that she has committed suicide otherwise some other antemortem injuries must be there and the delay in filing the F.I.R. shows that this case is an afterthought one. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 20.01.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is
Patna High Court CR. MISC. No.48374 of 2025(4) dt.04-12-2025 3/3 inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 20th Additional Sessions Judge, Muzaffarpur in connection with Sakra P.S. Case No. 627 of 2024.
