====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 27-07-2021 Heard learned counsel for the parties through video conferencing.

The petitioner has filed the instant application for grant of regular bail in connection with Makhdumpur (Tehta O.P.) P.S. Case no.64 of 2017 registered under sections 302, 384 and 34 of the Indian Penal Code.

As per allegation in the F.I.R., it is stated by the informant that her son was taken away by the accused persons and after being killed was thrown in the well. It is further stated that accused persons used to make demand of Rs.50,000/. It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He happens to be mausera devar of the informant. No material has been transpired in course of investigation to link the petitioner with the alleged crime. No.6619 of 2021(3) dt.27-07-2021 2/2 was more than 3 years after registration of the FIR that suspicion was raised against the petitioner of having illicit relationship with the mother of the deceased and that the location of the tower of the mobile number of the petitioner were found in the same place. The petitioner is in custody since 18.9.2020 and chargesheet has been submitted in the case. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the material that has been collected against the petitioner together with the petitioner being in custody for over 9 months and investigation of the case having concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Makhdumpur (Tehta O.P.) P.S. Case no.64 of 2017 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad.
