JUSTICE RAKESH KUMAR ORAL ORDER 03-12-2015 Heard Sri Nilesh Kumar, learned counsel for the petitioner, learned A.P.P. as well as Sri Ambika Bhgat, learned counsel, who has voluntarily appeared on behalf of the informant. The petitioner, who is in custody in connection with Asthawan P.S. Case No. 33 of 2015 registered for the offence under section 307 and other allied Sections of the Indian Penal Code, Section 27 of the Arms Act and subsequently Section 302 of the Indian Penal Code was added, has prayed for grant of bail. Learned counsel for the petitioner submits that on the basis of post- mortem examination report allegation is not corroborated and as such, the petitioner deserves to be enlarged on bail.

Learned counsel for the informant has opposed the

Patna High Court Cr.Misc. No.52333 of 2015 (2) dt.03-12-2015 2/2 prayer for bail. He submits that on the basis of F.I.R. it is evident that petitioner is the main assailant who opened fire on the father of the informant.

I have perused the F.I.R. The petitioner is the main assailant. I do not find it a fit case for grant of bail. The bail petition stands dismissed.
