This application for anticipatory bail arises out of Complaint Case No. 1951-C of 2015 for the offence punishable under Sections 420, 467 and 468 of the Indian Penal Code. The allegation against the petitioner is that she got a sale deed executed in her favour in respect of which the cosharer of her vendor had executed sale deed in favour of the complainant.

Learned counsel appearing on behalf of the petitioner submits that no offence can be said to be made out against the petitioner and the dispute, if any, is purely of civil nature.

I am convinced with the submission so advanced

Patna High Court CR. MISC. No.48571 of 2019(2) dt.05-08-2019 2/2 on behalf of the petitioner for the purpose of grant of anticipatory bail. This application is accordingly allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jamui, in Complaint Case No. 1951-C of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
