1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Paliganj P.S. Case No. 37 of 2024 dt. 24.01.2024 registered for the offence under section 302 of the I.P.C.
3. As per the prosecution case on 22.01.2024 in the night the informant's son Amlesh Kumar was killed by pressing his neck. On the date of occurrence the informant's son was alone in his house and the incident was informed by Mithu @ Dharmvir Kumar on phone that informant's son has been killed. It has been alleged that petitioner had threatened that his son would be killed.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of suspicion only. At the time of occurrence the deceased was alone in his
Patna High Court CR. MISC. No.60597 of 2024(4) dt.14-05-2025 2/2 house and no body has seen the occurrence. There is no eye witness to the same. Only on the basis of suspicion the petitioner has been made accused in the present case.
5. Learned counsel for the informant as well as State referring to the case diary submits that there is strong suspicion in the F.I.R. against the petitioner. During course of investigation it has come that petitioner's daughter was having illicit relationship or love relationship with the deceased which was not to the liking of the petitioner. The petitioner threatened the wife of informant that the deceased should leave the company of his son otherwise he would be killed.

Having heard learned counsel for the parties, taking into consideration the fact that in the F.I.R. strong suspicion has been raised against the petitioner and during investigation it has come to light that there was some relationship between the deceased and the petitioner's daughter, as such, I am not inclined to grant anticipatory bail to the petitioner.
