The statement of victim appears to have been recorded under Section 164 of the Cr.P.C. in which she has nowhere stated about the allurement or her kidnapping. The victim disclosed her age as 20 years whereas the concerned Magistrate assessed her age as 18 years.

Although, the medical board found the victim between 14 to 15 years and the victim has already been handed over to her mother but taking into consideration the statement of victim as well as this aspect of the matter that petitioner is in jail custody since 30.06.2014, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two
