JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.9.2017, seeks bail in Gandhi Maidan PS Case No. 314 of 2017 registered under Sections 461 and 380 of the IPC.

Learned Counsel for the petitioner submits that no incriminating material has been recovered from his possession, he has been made accused only on the basis of confessional statement of co-accused, though similarly situated other accused persons have been admitted to bail by the court below itself but on account of criminal antecedent the petitioner's bail was rejected. Having considered the said facts and circumstances, the petitioner, namely, Sanjay Sao is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge VI - cum-ACJM Patna in connection with Gandhi Maidan PS Case No. 314 of 2017.
