The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467, 468, 471, 419, 420 and 120B of the Indian Penal Code. The prosecution case is that on 03.07.2015, on secret information, 65 trucks were seized loaded with coal, when it is alleged that the seized coal were being transported without any valid document. Subsequently, on the confession of apprehended co-accused, house of the petitioner was raided when Ink pad, one stamp of M/s Maruti UD Yog Propriter and one modem of Micromax company having Airtel's company SIM were recovered. It is submitted by learned counsel for the petitioner that nature of recovery does not suggest the complicity of the

Patna High Court Cr.Misc. No.53096 of 2015 (2) dt.23-11-2015 2/2 petitioner in transportation of coal illegally. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, (Dehri-on-Sone) Dehri, Sasaram in connection with Dehri (T) P.S. Case No.306 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
