JUSTICE SUDHIR SINGH ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 341, 323, 504, 326, 307/34 of the Indian Penal Code and 27 of the Arms Act.
Allegation is that the petitioner started firing on the informant and the informant tried to flee away but he received one fire arm injury on his right waist, due to which he became injured. He was taken to the Hospital for treatment. It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.4.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated
Patna High Court CR. MISC. No.47909 of 2019(3) dt.27-09-2019 2/2 in the present case due to village politics. The petitioner is alleged to have fired upon the victim. The doctor reserved opinion in respect of nature of injury. There is nothing on record to show whether the injury is grievous or simple. It is further submitted that the petitioner may be released on bail after completion of nine months in custody from 2.4.2019. On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of nine months in custody from 2.4.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Bhojpur, Ara in connection with Narainpur P.S. case No.71 of 2018.
