JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2017 This is an application for grant of anticipatory bail for offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that he is still ready to keep his wife and there is general and omnibus allegation against the petitioner.
Heard learned A.P.P. as well as learned counsel for the complainant and they have opposed the prayer for anticipatory bail. Learned counsel for the complainant has submitted that from the order of the learned Sessions Judge it appears that petitioner is
Patna High Court Cr.Misc. No.8771 of 2017 (2) dt.28-02-2017 2/2 not ready to dissolve the dispute as he has illicit relationship with another lady.
Having heard both sides and from perusal of the impugned order it appears that petitioner is not ready to settle the matter.
Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.
However, petitioner is directed to surrender in the court below, i.e., learned Sub-Divisional Judicial Magistrate, Katihar, in connection with Complaint Case no. 544 of 2015 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
