The petitioners apprehend their arrest in Belsand P.S. Case No.195 of 2018 registered under Section 307 and other Sections of the Indian Penal Code and Section 37(b) of Bihar Prohibition and Excise Act.

The learned counsel for the petitioners submits that there is omnibus and general allegation against the petitioners. Petitioners were not apprehended on the spot. The police arrested Manoj Mallic and Binod Mallic. The injured did not get any injury but it appears that informant made allegation that the petitioners and others indiscriminately assaulted Rita Devi, Ramkali Devi, Ghuran Devi and they became unconscious. They were brought to S.K.M.C.H. but the injured were referred

Patna High Court CR. MISC. No.48653 of 2019(2) dt.05-08-2019 2/2 to another hospital for better treatment. The injured are being treated in a private nursing hospital.

Taking into consideration the fact that the petitioners made indiscriminate assault on three ladies who got different injuries and they are under treatment, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
