This is repeat application seeking bail in Atri P.S. Case No. 08 of 2015 registered under section 307 IPC. Earlier, the petitioner along with other co-accused(s) had prayed for bail which was considered and disposed of vide order dated 19.05.2015 (Annexure-1). The prayer for bail on behalf of the petitioner was rejected giving liberty to renew his prayer after five months.

It is stated that due to land disputes the case has been lodged. The petitioner is languishing in jail since 20.01.2015. He has no criminal antecedent.

Considering the submission and observation made in the

Patna High Court Cr.Misc. No.52727 of 2015 (2) dt.16-12-2015 2/2 order dated 19.05.2015, I direct release of the petitioner above named on bail on furnishing bail bond of Rs. 10,000/-with two sureties of the like amount each to the satisfaction of CJM, Gaya in Atri P.S. Case No. 8 of 2015 on conditions that one of the bailors shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall cancel his bail bonds. (Kishore Kumar Mandal, J) HR/- U T
