Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Jogbani P.S. Case No. 08 of 2022, registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. As per allegation, the accused persons, including the petitioner, caused dowry death of the daughter of the informant for non-fulfilment of demand of dowry.

The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and has falsely

He has submitted further that he is cousin father-in-law (Chachera Sasur) of the deceased having no concern with the affairs of the couple. He has also submitted that father-in-law and brother-in-law (devar) have been granted anticipatory bail vide Criminal Miscellaneous No. 21417 of 2022 by a co-ordinate Bench of this court and the case of the petitioner is on better footing.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Araria in connection with Jogbani P.S. Case No. 08 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
