JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 16.3.2017 passed in Cr.Misc.No. 46664 of 2016 with a direction to learned trial court to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that though charge has been framed in this case but not a single witness has been examined till date and petitioner is in custody since 19.1.2016.

Heard learned APP and perused the report, from which it appears that the case is still fixed for evidence and no prosecution witness has been examined.

Having heard both sides and in view of facts and circumstances, let the petitioner, above named, be released on bail

Patna High Court Cr.Misc. No.7224 of 2018 (3) dt.28-02-2018 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-VII, Patna City, in connection with Sessions Trial No. 538 of 2016, arising out of Agamkuan P.S.Case No. 565 of 2015, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in disposal of trial and appear before the court as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
