JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Initially, the present case was registered for the offences punishable under Sections 376, 364/34 of the Indian Penal Code but police after due investigation, submitted charge sheet against the petitioner for the offences punishable under Sections 363/365 of the Indian Penal Code.

No doubt, in course of investigation, some witnesses claimed to have seen the petitioner and victim going on the alleged date of occurrence but taking note of the aforesaid facts as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each
