The petitioners apprehend their arrest in connection with Udakishunganj P.S. Case No. 117 of 2015 for offences punishable under Sections 147, 148, 149, 341, 323, 324, 506, 504, 448, 380 and 307 of the Indian Penal Code.
Learned counsel for the petitioners with reference to an FIR present at Annexure-3 submits that it is after the wife of one of the co-accused has instituted a police case against the informant and his family members giving rise to Udakishunganj P.S. Case No. 116 of 2015 that the present case has been instituted with general and omnibus allegations. He submits that the altercation is a result of civil dispute in between the parties.
Patna High Court Cr.Misc. No.4969 of 2016 (2) dt.17-03-2016 The prayer for bail is vehemently opposed by the counsel for the informant.
Having heard learned counsel for the parties and considering the omnibus nature of allegation present in the FIR, let the petitioner no. (1) Sanjay Roy; and petitioner no. (2) Lalan Yadav @ Lalan Roy in the event of their arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Madhepura in connection with Udakishunganj P.S. Case No. 117 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) S.Sb/- U T
