Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 308, 324, 323, 341/34 of the Indian Penal Code.

It is alleged that it is a case of assault to the informant side due to which three persons namely Rajaram Paswan,

Patna High Court CR. MISC. No.60736 of 2021(2) dt.27-04-2022 2/2 Abhishek Kumar and Indrajeet Paswan were injured. Learned APP for the State vehemently opposes the case on behalf of the petitioners that it is a case and counter case. Both the parties have sustained injury as alleged in a separate incident.

From perusal of the injury report which annexed with this petition shows that the injury sustained by the injured are simple in nature. A statement made in para 3 of the petition that petitioners have no criminal antecedent.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, District- Aurangabad in connection with Obra P.S. Case No. 134/2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
