1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code.

3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on account of dispute relating to property, his elder brother along with family members including the petitioners assaulted him by rod and Neeraj Singh gave a fist blow causing injury near his eyes, thereafter accused persons

Patna High Court CR. MISC. No.52463 of 2024(2) dt.26-07-2024 2/3 also assaulted his wife and children and the petitioners took his thumb impression on a blank paper.

4. The learned counsel for the petitioners submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that informant and Kameshwar Singh are own brothers and they are having dispute relating to property and petitioner no.1 is son of Kameshwar Singh, as such, is nephew of the informant and he along with his wife have been implicated in the instant case with an allegation that petitioners took thumb impression of the informant, but then, it is not the case of the informant that his thumb impression was misused, which amply demonstrates that the instant F.I.R. has been instituted only to coerce his brother's family into submission.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VIII,

7. The application stands allowed.
