2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 306/34 of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act. 3.Informant's sister was married with the petitioner 13/14 years back. Later on, petitioner and his family members started subjecting her to cruelty and harassment for nonfulfilment of demand of dowry. It is further alleged that on 22.4.2024 informant received information that his sister was admitted in the hospital. On reaching there, informant found his sister lying unconscious with foam coming out of her mouth. Sister of informant died during treatment.
4. Learned counsel appearing for the petitioner submits that petitioner and sister of informant were living peacefully and enjoying cordial marital relationship. Deceased
Patna High Court CR. MISC. No.56793 of 2025(4) dt.18-09-2025 2/2 was suffering from chronic gastric disease and other ailments for which she was regularly under medical treatment. Two days prior to the incident, she consumed overdose of medicines which led to complications. During investigation, daughter of deceased has stated that her mother was suffering from gastric ailments and she took overdose of medicines due to which her condition became worsen and no one administered her poison. Petitioner is husband of the deceased who died of some ailment. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer for bail. He submits that petitioner is the husband of the deceased and there is direct and specific allegation that he and his family members killed the deceased for non-fulfilment of dowry demand.
6. Considering the fact that the petitioner is husband of the deceased, who died in unnatural condition in her in-laws house, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Shashi U T
