The petitioner apprehends his arrest in Complaint Case No. 671-C of 2013 in which prima facie case under Sections 323, 379 and other sections of the Indian Penal Code was found to proceed against the petitioner and Balram Mahto. The complainant alleged that while he was going to bank to deposit money on 25.02.2013, the petitioner and his father assaulted the complainant and snatched Rs. 10,000/- from his possession at the point of pistol.

Learned counsel for the petitioner submits that the allegation is false and concocted. The occurrence took place on

Patna High Court Cr.Misc. No.13342 of 2017 (3) dt.02-05-2017 2/2 25.02.2013 and the complaint was filed on 28.02.2013. No information was given to the police. The complainant is said to have disclosed that there was no witness near the place of occurrence. It is submitted that the petitioner is a bank employee. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in Complaint Case No. 671-C of 2013 as laid down under Section 438(2) of the Code of Criminal Procedure.
