The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 143, 147, 149, 151, 341, 325, 353, 504, 506 of the Indian Penal Code and 3/4 of the Prevention of Public Property Damage Act.

The prosecution case is that the petitioners along with others were inciting the mob for blocking the road and obstructing the police to discharge official duty. The protest was being made for lodging Pupri P.S. Case No. 200 of 2015 when 77 cattle were seized and 4 cattle smugglers were arrested.

It is submitted by the learned counsel for the petitioner that accusation is against the mob and police

Patna High Court Cr.Misc. No.3597 of 2016 (2) dt.22-01-2016 maliciously lodged the present case. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the accusation against the mob, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupari in connection with Pupri P.S. Case No. 201 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
