Mr. SMT PUSHPA SINHA ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Bakhari P. S. Case No. 233 of 2017 registered for the offences punishable under Section 302 r/w 34 of the Indian Penal Code. Allegation against petitioner is that he along with other accused persons arrived over the land of informant and forcibly unloaded soil by tractor. On protest made by father of informant, he was assaulted, as a result of which he fell down on the ground. Thereafter, he was brought to Primary Health Centre Bakhari but he was declared dead by doctor. It has been submitted on behalf of the petitioner that he has been implicated in this case on the basis of false allegation. Informant is not the eye witness to the occurrence. There is general and omnibus allegation against all the accused persons.

Patna High Court Cr.Misc. No.6584 of 2018(3) dt.27-02-2018 2/2 There is nothing specific against petitioner. There was land dispute between the parties prior to the occurrence. Petitioner has no criminal antecedent. He is in judicial custody since 28.11.2017.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-V, Begusarai, in connection with Bakhari P. S. Case no. 233 of 2017.
