Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 504 and 307/34 of the Indian Penal Code.
The allegation against the petitioner is of commission of injury at the neck of the informant with sharp cutting weapon. The Doctor has found consistent injury. Petitioner is in custody since 14.12.2017. Investigation of the case is complete against the petitioner.
Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail for the present in connection with Noorsarai Police Station Case No. 278 of 2017 pending in the court of learned Chief Judicial Magistrate, Nalanda.
Patna High Court Cr.Misc. No.11130 of 2018 (3) dt.16-04-2018 2/2 Hence, prayer for bail is refused.
The trial court is directed to expedite and conclude the trial within a period of nine months from the date of receipt/production of a copy of this order. If the trial is not concluded within the aforesaid period, the petitioner would be at liberty to renew the prayer for bail before the court below itself who shall pass a reasoned order.
