The petitioners seek bail in anticipation of their arrest in connection with Daudnagar P. S. Case No. 183 of 2020, dated 06.07.2020, instituted for the offences under Sections 341, 323, 324, 307, 506, 448, 504 and
Patna High Court CR. MISC. No.5840 of 2021(2) dt.26-10-2021 2/3 34 of the Indian Penal Code.
The accusation in the F.I.R. is that all the petitioners came to the house of the informant, ransacked the house and also assaulted the members of the prosecution party.
The learned advocate for the petitioners has submitted that there is a counter version of the occurrence also.
The parties are agnates and there is a land dispute between them.
One Amrendra Kumar is said to have been injured in the occurrence who has received superficial/minor injury.
Nothing specific has been alleged against the petitioners and it appears, it has been argued, that only because of land dispute between the parties, this case has been lodged.
Regard being had to the afore-stated facts, the petitioners, above-named, are directed to be released on
Patna High Court CR. MISC. No.5840 of 2021(2) dt.26-10-2021 3/3 bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Daudnagar P. S. Case No. 183 of 2020, subject to the conditions as laid down under Section 438
(2) Cr.P.C.
The application stands allowed.
