JUSTICE ARUN KUMAR ORAL ORDER 11-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 10.1.2018, seeks bail in Adapur PS Case No. 10 of 2018 registered under Sections 25(1-b)a, 26 and 35 of the IPC.

The allegation in brief is that the police on secret information apprehended the petitioner along with Arbind Thakur and from the possession of the petitioner a mobile and from another accused a country made pistol was recovered.

Learned Counsel for the petitioner submits that there is no recovery of any arms from the possession of the petitioner only his personal mobile has been recovered.

Having considered the said facts and circumstances, the petitioner, namely, Prakash Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Raxaul at Motihari, East Champaran in connection with Adapur PS Case No. 10 of 2018.
