JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-01-2017 This is an application against the order, dated 07.07.2014, passed, by learned Additional Sessions Judge II, Muzaffarpur, in Sessions Trial No. 65 of 1987, whereby the learned Additional Sessions Judge II, Muzaffarpur, has rejected the petitioner's application to call for investigation report of the C.I.D.

I have perused the order impugned, from which it appears that the charges in the present case were framed on 03.12.1987 and at no point of time, any plea of this nature was raised nor any request was made calling for the investigation report of the C.I.D. The Court below has recorded that the said application seeking investigation report of the C.I.D. has been filed merely to delay the disposal of the trial.

Patna High Court CR. REV. No.828 of 2014 (3) dt.12-01-2017 2/2 The observations made by the learned Court below in the impugned order that filing of the application by the petitioner to call for investigation report of the C.I.D. was for the purpose of delaying trial appears to be correct.

This application has no merit and it is, accordingly, dismissed.
