JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-02-2016 The present application has been filed for modification of order dated 08.10.2015 passed in Cr. Misc. No. 41724 of 2015 to the extent of deleting the statement made in paragraph 3 of the main petition that the petitioner has no criminal antecedent as the counsel came to know subsequently that the petitioner is made accused in one other case and for extending the period of surrender.
On the grounds mentioned in the modification application, the period of surrender is extended by three weeks from the date of receipt/production of a copy of this order in connection with Sikandra P.S. Case No. 188 of 2014 pending in the court of learned Judicial Magistrate, Ist Class, Jamui. The order dated 08.10.2015 stands modified to
Patna High Court Cr.Misc. No.4298 of 2016 (2) dt.10-02-2016 2/2 the extent indicated above.
Let the learned court below consider the prayer for regular bail of the petitioner without being prejudiced by the statement in earlier order with regard to statement made in paragraph 3 of the main petition.
Accordingly, this modification application is disposed of.
