JUSTICE SANJAY PRIYA ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections-304(B)/201 of the Indian Penal Code.
It has been submitted that the petitioner is mother-inlaw of the deceased. It has further been submitted that the matter has been compromised between the parties.
Learned counsel for the informant has appeared and he has also stated that compromise has taken place between the parties.
From the written report, it appears that there is general
Patna High Court Cr.Misc. No.9608 of 2017 (3) dt.04-04-2017 2/2 and omnibus allegation against the petitioner. Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner named above, in the event of her arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bhagwanganj P.S. Case No. 46 of 2016 to the satisfaction of Shri N. K. Tiwary, learned Judicial Magistrate-Ist Class, Masaurhi, Patna subject to conditions as laid down u/S 438(2) of the Cr.P.C.
(3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
