1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is aged about 76 years the informant alleges that on account of dispute relating to property, the petitioner along with his family members assaulted him by rod and Neeraj Kumar Singh gave a fist blow causing injury near his eyes. Thereafter, the accused persons also assaulted his wife and children and Deepak Singh took his thumb impression on a blank paper.

The learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that informant and the petitioner are own brothers and they are having dispute relating to property based on which, the instant false case came to be instituted. It is also submitted that a person, who has remained a person with clean antecedent for 76 years, all of a sudden, has been made a criminal with general and omnibus allegation of assault.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VIII, Saran at Chapra in connection with Amnour P. S. Case No.96 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
