Taking into account the nature of allegation in consonance with the disclosure whereunder there happens to be fragrance of exercise of rights amongst the parties, it looks better to direct the petitioners to surrender before the learned lower court with a prayer for bail whereupon the learned lower court will consider favorably more particularly confining himself with regard to disclosure made by the informant himself that some sort of Patta was existing in favour of petitioners since before inconsonance with the allegation.
Patna High Court Cr.Misc. No.33162 of 2014 (4) dt.23-03-2015 With the aforesaid observation, instant petition is disposed of.
