JUSTICE RAVI RANJAN ORAL ORDER 17-12-2015 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offence punishable under Sections 302/34 of the Indian Penal Code.
It is submitted on behalf of the petitioners that in fact petitioner no.2 is the informant and both the petitioners are brother and nephews of the deceased. There is nothing against the petitioners except suspicion that they might have killed their aunt as they would be benefited being the heirs of the deceased. One of the co-accused, namely, Brahmdeo Singh, who is the brother of the petitioners, has already been granted bail. Having regard to the aforementioned facts and
Patna High Court Cr.Misc. No.52669 of 2015 (2) dt.17-12-2015 2/2 circumstances, the petitioners, namely, Kamlesh Singh and Basudeo Singh @ Basdeo Singh are directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 11th Additional Sessions Judge, Muzaffarpur in Sessions Trial No.169/2015 arising out of Sakra P.S. Case No.240/2009.
