Petitioner, already in custody, seeks bail in connection with Maharajganj P.S. Case No.189 of 2017, registered under Sections 302, 120(B) and 34 of the Indian Penal Code. Allegation in brief is that the informant received information that her son was murdered by stabbing and the dead body is thrown by the side of the premises of the railway station. When the informant reached in the Sadar Hospital, she found Archana Kumari, her father and mother standing there so suspected their hand in killing of his son.

Learned counsel for the petitioner submits that mere suspicion is raised against the petitioner, had the petitioner killed the son of the informant, he would not have remained

Patna High Court Cr.Misc. No.8873 of 2018(2) dt.15-02-2018 2/2 present at the hospital, only suspicion is raised and Archana Kumari was granted bail by the court below, petitioner has no criminal antecedent and charge-sheet has been submitted in this case.

Having considered the said facts and circumstances, petitioner Rama Ji Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Siwan in connection with Maharajganj P.S. Case No.189 of 2017.
