====================================================== CORAM: HONOURABLE MR. JUSTICE A. ABHISHEK REDDY ORAL ORDER 24-07-2026 Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of 'Admission'.

Learned counsel for the petitioner submits that the vehicle of the petitioner bearing Registration No. BR50GB2829 was plying between the Bengal to Purnia and the authority has imposed penalty of Rs. 11,36,300/- solely on the ground that the Inter-State Transit Pass (ISTP) was not present with the petitioner. Learned counsel submits the date on which the

Patna High Court CWJC No.11120 of 2026(2) dt.24-07-2026 2/3 authority has seized and imposed the penalty was on 10.06.2026 and on the very same day the requirement having ISTP for the vehicles which are plying interstate pass was brought into force. Learned counsel submits that the state government duly taking into consideration that most of the vehicles do not have the ISTP, have mentioned in the notification dated 01.06.2026 (Annexure- P/4) stating said provision will be effective from 10.06.2026 but the strict implementation of the porivision will be from 12.06.2026. Learned counsel submits that without taking the above notification into consideration, the authorities have imposed a fine of Rs. 11,36,300/- and also seized the vehicle vide order dated 10.06.2026 (Annexure- P/2). Learned counsel, therefore, seeks a direction from this Hon'ble Court to direct the authorities to release the vehicle and also waive the penalty imposed.

3. Per contra, Ms. Shruti Singh, the learned counsel representing Shri Naresh Dixit, Spl. P.P. (Mines) while not controverting the above G.O. issued by the government submits that the petitioner may approach the District Mining Officer/ Mines Development Officer, Purnia (Respondent No. 4) with a representation bringing to his notice the above mentioned facts and the same shall be considered in accordance with law.

Having regard to the fact that the petitioner has already made a representation dated 22.06.2026 (AnnexureP/6), the Respondent No. 4 is directed to consider the same duly taking note of the fact that the government itself has issued the notification with effect from 10.06.2026 but with a rider that the same will be strictly implemented from 12.06.2026. Further, the authority shall also duly take into consideration that no other violations by the petitioner are alleged except the fact that he does not have the requisite ISTP, the authority shall pass necessary orders within a period of two weeks from the date of receipt of the copy of this order. Any decision taken by the Respondent No. 4 shall be communicated to the party.

5. With the above directions, the present writ petition stands disposed of.
