JUSTICE ARUN KUMAR ORAL ORDER 02-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Hathua PS Case No. 200 of 2017 registered under Sections 30(a), 38 and 41(i)(ii) of the Bihar Prohibition and Excise Act.
Learned Counsel for the petitioner submits that the petitioner is owner of Ice- cream factory and in the tin shed of the factory 43.2 litres of foreign liquor was recovered in concealed position and the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely Sujeet Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II -cum- Special Judge (Excise) Gopalganj in connection with Hathua PS Case No. 200 of 2017.
