The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 498A, 323, 341, 494, 504/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Basic accusation is of torture for non-fulfillment of dowry demand and performing second marriage.

Though, both sides are ready to get the issue resolved through mediation but it is submitted by learned counsel for the informant that processes under section 83 of the Code of Criminal Procedure has already issued.

In that circumstance, this Court is not inclined to grant anticipatory bail to the petitioner.

Patna High Court Cr.Misc. No.4888 of 2016 (3) dt.08-02-2016 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, keeping in view of the fact that both sides agreed to resolve the issue through mediation, if the petitioner surrenders within a period of six weeks in connection with Nawada Mahila P.S. Case No.37/2015, pending before the learned SDJM, Nawada.

With the above observation, this application is, accordingly, disposed off.
